These Terms and Conditions apply to all Wholesale customers . Please read through these Terms and Conditions carefully prior to accessing and/or placing an order for any Drinks from this Website.
All purchases made on this website or out are controlled by these Terms and Conditions. The Terms and Conditions governing your purchase will take effect on the date of your purchase. We reserve the right at our sole discretion to amend these Terms and Conditions at any time. If you order goods after we have published any changes to the Terms and Conditions you will be bound by those changes. Accordingly, you should ensure that you understand the quantity Terms and Conditions applicable to your order, before placing your order.
Please note: Using this Website indicates that you accept all our Terms and Conditions together with our Privacy Policy, regardless of whether or not you choose to register with us.
Placing an order:
By placing an order within our site, you authorise the following:
Legally entering into binding contracts;

Responsible for acting in accordance with the UK and US Law. We cannot be held responsible for individuals who choose to act in conflict with national laws and we do not encourage anyone to do so.
Items purchased are intended for legal use only.

How the contract for the goods is formed between you and our company:
We will confirm receipt of your order as soon as possible by WhatsApp or email , to the number or email address that you have provided to us.
Please ensure the number or email provided is correct and accurate.
Our acceptance of your order will take place upon the dispatch of the product(s) ordered and at this point the contract will be made. We will supply the product(s) to you in accordance with these Terms and Conditions.
Goods
A brief description of the main characteristics of the Drinks can be found on the product pages of the Website. Where a description isn’t available and you would like more information, please contact us via WhatsApp.
Delivery charges are shown separately when ordering and must also be paid in advance but in case we decide to offer prices of the product and delivery fee this law won’t be applied. Please see information regarding Shipping and Delivery.
Please note: All Drinks will have a use by date of at least 7-24 Months. Any Drinks that have a use by date less than 7 months, we will aim to notify you of this as soon as possible.
If by accident you do receive goods that are short dated, please notify us within 24 Hours via our WhatsApp or Email.
Price and Payment
This is strictly a Trade Only Wholesale website.
Please note: There is a 3 pallets minimum order requirement when placing an order on Drinks Wholesale website. Any orders below will not be accepted.
Please note: Drinks Wholesale Wholesale strictly does not offer any form of Retail Sale.
•Drinks Wholesale does not offer a drop shipping Service.
Prices maybe subject to change without any notice but changes will not affect any orders that have already been accepted by us.
The Website contains a number of Products and it is possible that, despite our best efforts, some of the Products listed on our catalog may be incorrectly priced. If an error is discovered at our end in the price of the goods, you will be informed as soon as possible. We will give you the option of reconfirming your order at the correct price or cancelling it.
Payment for all Products must be by our accepted payment methods. A list of our available payment will be forwarded to you.
Drinks Wholesale isn’t under any obligation to sell incorrectly priced goods to you at the incorrect price.
Method of payment
We accept Bank Transfer as the Main payment method, sometimes few other payment methods will be given according the Region of sales.
Pallet Deliveries
If your order is sent on a pallet then you have 24-48hrs to check your order is intact and complete. No liability for any damages or discrepancies will be accepted if the proof of delivery is signed for as correct or unchecked.
If your Pallet has arrived Damaged, please ensure it is signed and checked by the delivery driver. Please ensure a signature is obtained from the driver and photos/videos taken for evidence as this may be asked for, during our investigation.
Returns
At FMCG Drinks Wholesale, our aim is to provide a fair Returns and Replacements Policy, ensuring you can be satisfied with each and every order from us.
Please be aware that we always try our best to describe the items we sell as accurately as possible. However, please note that images are for illustration purposes only.
You have a legal obligation to take reasonable care of the items while they are in your possession. If you fail to comply with this obligation, FMCG Drinks Wholesale limited may have a right of action against you for compensation. This applies to all items that are returned.
Order errors and/or discrepancies must be notified to us in writing within 72hours of receipt.
If your order is delivered to you damaged, please contact us immediately along with photographic/video evidence. We will then advise further and you will be refunded once the damaged items have been received back by us.
The refund will be processed via the initial method of payment.
If the Goods returned are not in the condition in which they were sent out, FMCG Drinks Wholesale Limited reserves the right to send the item back to you or provide only a partial refund after assessing the items for damages.
You are responsible for any damages caused to the goods being returned in transit by inappropriate packaging. We would advise taking photographs of your returning goods prior to sending them back to us.
FMCG Drinks Wholesale does not accept returns for Clearance/Sale Products and FMCG Drinks Wholesale Warranty does not apply to those.
Missing Items
If it is discovered that Items in your order are missing, FMCG Drinks Wholesale highly recommend checking your order once again, making sure all corners of the box/boxes are thoroughly checked as well as the packaging material used.
For any orders containing errors and/or shortages you must notify FMCG Drinks Wholesale within 24 hours of receipt. Please ensure you have images to support your enquiry. I.e. images of the damaged Pallet/Parcel or Damaged Goods.

Refunds
Once a refund has been issued you will receive a confirmation email detailing the amount which has been refunded and the item(s) FMCG Drinks Wholesale has received back. If a refund or reimbursement is payable to you, FMCG Drinks WHOLESALE will transfer the money using the same method originally used by you to pay for your Order.
Warranty
Your warranty does not cover faults caused by misuse or accident.
If there is any visible outer damage or signs of dropping, then your warranty will be voided for those products.
We aims to process all returns as quickly as possible and you should receive confirmation of this within 7 Days of having returned the item. Please note that at busy times of the year such as public holidays, these times may increase.
Our liability
If an order hasn’t been delivered, contains incorrect items/incorrect quantity, contains damaged/faulty products, our obligation will be to either:
Rectify any shortage/non-delivery/incorrect delivery
Replace any Products that are damaged/Faulty
Provide a full Refund for the Products in question after investigation
Please note; The above must be subject to our Returns Policy.
If we fail to comply with these Terms and Conditions we are responsible for the loss and/or damage you suffer that is a foreseeable result of our breach of these Terms and Conditions or our negligence, up to the amount of the purchase price paid by you for the products order.
Our maximum liability is limited to the total cost of your order. We are not however responsible for any loss or damage that is not foreseeable. Loss and or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time you placed the order.
Events outside our control
Drinks Wholesale will not be liable or responsible for any failure to perform, or delay in performance of any of its obligations to you that is caused by events outside Drinks Wholesale’s reasonable control (a “Force Majeure Event”). A Force Majeure Event includes any act, event, non-happening, omission or accident beyond Drinks Wholesale’s reasonable control and includes (without limitation) the following;
(a) Strikes, lock-outs or other industrial action;
(b) Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
(c) Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
(d) Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
(e) Impossibility of the use of public or private telecommunications networks; or
(f) The acts, decrees, legislation, regulations or restrictions of any government.
In the event of a Force Majeure Event, FMCG Drinks Wholesale’s performance is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use its reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which its obligations to you may be performed despite the Force Majeure Event.
